Terms of service

These Terms of Service ("Terms") govern your use of the SectionOS website at sectionos.io and, where no separate agreement is in place, your organization's use of the SectionOS platform. They are entered into between you, or the organization you represent, and Picsume Inc. ("Picsume," "we," "us"), an Ontario, Canada corporation.

If you have a signed agreement, it comes first

If your organization has signed a Master Services Agreement, Platform Services Addendum, or Statement of Work with Picsume for SectionOS, that agreement governs your platform use and takes precedence over these Terms wherever the two conflict. These Terms fill any gaps that agreement doesn't cover, and they always govern your use of the public website.

Using the website

You may browse sectionos.io, submit inquiries, and request a demo. You agree not to:

  • Misrepresent your identity or organization when contacting us
  • Attempt to access, scan, or disrupt the site or its infrastructure beyond normal browsing
  • Use content from the site, including copy, design, or product descriptions, to build a competing offering

Using the platform

Organizations that engage Picsume to operate SectionOS do so under a separately executed services agreement, which sets out fees, service levels, data handling, and support commitments specific to that engagement. Individual users your organization authorizes to use the platform, for example staff at each location in your network, are bound by any acceptable use terms your organization puts in place, and by the platform's built-in permission and governance model.

Intellectual property

Picsume owns SectionOS: the platform, its architecture, the section and template library, and the underlying code. Nothing in these Terms transfers that ownership to you. Your organization retains ownership of the content, brand assets, and data it publishes through the platform. Where a services agreement grants additional intellectual property terms specific to your engagement, that agreement controls.

No warranty

The website, and absent a separate agreement stating otherwise, the platform are provided "as is." We don't guarantee uninterrupted or error-free operation. Specific service levels, uptime commitments, and support obligations are defined in a services agreement where one exists, not in these Terms.

Limitation of liability

To the extent permitted by law, Picsume's liability arising from your use of the website, or absent a separate agreement, the platform, is limited to the amount you've paid us in the twelve months before the claim, or CAD $100 if you haven't paid us anything. We aren't liable for indirect, incidental, or consequential damages.

Termination

We may suspend or restrict access to the website or platform for misuse of the kind described above. Termination of a paid platform engagement is governed by the applicable services agreement.

Governing law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

Changes to these Terms

We may update these Terms as SectionOS evolves. We'll update the effective date above when we do. Material changes affecting an active customer relationship will be communicated directly and are also governed by the change terms in that customer's services agreement.
